Strategic environmental litigation

This theme will be explored with an emphasis on the implementation of strategies that mobilize multiple judges in order to make the ecological transition a truly cross-cutting issue. The strategy put in place in relation to the United Nations General Assembly's request for an advisory opinion from the International Court of Justice (ICJ) on the obligations of States with regard to climate change, and the recent opinion of the International Tribunal for the Law of the Sea (ITLOS), seem to us to be particularly illustrative of this trend. We observe similar strategies in domestic and European law. In particular, we wish to analyze the mechanisms by which international advisory and contentious opinions can be made effective at national and European level. We believe that analyzing the political communication surrounding these cases could be useful in determining their true scope -which undeniably extends beyond the courtroom.
